GENERAL TERMS AND CONDITIONS OF HOCKEY CLUB LUGANO SA

Field of Application

For the purchase and use of tickets (single tickets, season tickets, packages), only the following general conditions apply, which the ticket holder accepts at the time of purchase or use. Access to the rink is also regulated by the National League regulations, the Swiss Ice Hockey Federation (SIHF) regulations, and the Hockey Club Lugano regulations posted outside the rink entrances. Other agreements between Hockey Club Lugano SA and the ticket holder are only valid if confirmed in writing. The contractual relationship exists only between the ticket holder and Hockey Club Lugano SA, the organizer of Hockey Club Lugano games and events.

Ticketing

Single Tickets
By purchasing a single ticket, the buyer acquires the right to attend the specific Hockey Club Lugano game indicated in the category and time slot. In case of cancellation or postponement of the game or event not caused directly by Hockey Club Lugano SA, there is no entitlement to a partial or full refund of the ticket price, nor to a return or exchange of the single ticket. The obligation to play games behind closed doors, any sector closures, or any rink disqualification, or games on neutral ground mandated by law or by public or sports authorities due to force majeure, public health, or other orders from competent bodies, do not generate the right to a refund or exchange of the single ticket. Travel expenses are the responsibility of the ticket holder. For game postponements, see the section “Postponements of Games or Events”.

Season Tickets/Packages
By purchasing a season ticket, the holder acquires the right to attend the Hockey Club Lugano games specified in the category and time slot. Packages refer to multiple single tickets that can only be purchased in one package, possibly at a discounted price and/or with additional services. Unless explicitly stated otherwise, the same rules that apply to season tickets also apply to packages. In case of cancellation, postponement, interruption, or delay of the game or event not caused directly by Hockey Club Lugano SA, there is no entitlement to a partial or full refund of the season ticket price, nor to a return or exchange. The obligation to play games behind closed doors, sector closures, rink disqualification, or games on neutral ground mandated by law or by public or sports authorities due to force majeure, public health, or other orders from competent bodies, do not generate the right to a refund or exchange of the season ticket. Travel expenses are the responsibility of the season ticket holder. The same rule applies to tickets sold as part of season tickets and packages. For any discounts or additional benefits for season ticket holders (e.g., pre-emption rights, shop discounts, etc.), only the communications on the official hclugano.ch website are valid. There are no legal claims in this regard.

Contract Conclusion/Order
Hockey Club Lugano offers its customers the opportunity to purchase single tickets and season tickets (or packages) in accordance with these general conditions at various sales points and online. The offer to conclude the contract always comes from the customer who places the order and makes the payment. The contract between the customer and Hockey Club Lugano SA is concluded with the order confirmation by Hockey Club Lugano SA, or with the dispatch or delivery of the single ticket, season ticket, or package. If, after the order, it turns out that the ordered seats are not or are no longer available, Hockey Club Lugano SA reserves the right to offer the purchaser other seats, as far as possible of equal value. The purchaser has the right to accept or reject the offer. Hockey Club Lugano reserves the right to define a maximum number of single tickets, season tickets, or packages orderable at any time and at its discretion.

Prices
The prices valid on the day of the order acceptance are decisive. Unless otherwise specified, prices are in Swiss Francs, including VAT and the security fee of 1 Franc per single ticket as decided at the cantonal level. Possible shipping and/or processing costs are excluded.

Payment Conditions
Orders are executed only after payment has been made using the payment methods provided by Hockey Club Lugano SA, such as credit cards, debit cards, or cash payments. The dispatch of tickets and season tickets or the delivery of tickets and season tickets always takes place only after full payment. In case of incomplete payments, payments made after the deadline, or insufficient credit card or account coverage, Hockey Club Lugano SA is authorized to cancel unpaid single tickets or season tickets, cancel the order without compensation, and/or block the single tickets or season tickets and put them back on sale. Hockey Club Lugano SA explicitly reserves the right to charge the customer processing costs and further damages arising from the situation.

Print@home Tickets
Using the print@home function, the purchased single ticket can be printed at home on A4 paper. The single ticket contains a barcode that is read at the entrance. The ticket holder is responsible for ensuring the barcode is printed legibly. Single tickets must be protected from dust and other damage. The single ticket cannot be printed, copied, or imitated multiple times. The first holder of a print@home ticket is admitted to the event. Other entries with the same print@home ticket are not allowed. If multiple prints, copies, or imitations of a print@home ticket are in circulation, the holders of the latter will be denied access to the rink without any right to a refund. The instructions on the print@home ticket are valid.

Delivery and Transfer of Risk / Complaint
Hockey Club Lugano SA delivers by means of transport of its choice at the cost and risk of the ticket holder. The latter must immediately check the number of tickets, season tickets, ticket packages, the price, the date, the event, and the location of the event upon delivery. Any complaint must be made immediately. If the complaint does not occur immediately after the customer has taken possession of the single ticket, season ticket, or package, any claim for return or new order lapses. Both single tickets and season tickets and packages contain a barcode that is read at the entrance. The holder is responsible for ensuring the barcode is not damaged.

Return and Exchange
The return and exchange of season tickets, packages, and single tickets are generally excluded. The return is reserved in case of postponement of the event.

Postponements of Games or Events
Hockey Club Lugano SA points out that the IIHF (International Ice Hockey Federation), SIHF (Swiss Ice Hockey Federation), the National League, and the political and/or police authorities issuing the relevant authorizations have the authority to postpone or cancel games even at short notice. Therefore, ticket holders are requested to regularly check for any changes to the game schedule on the official hclugano.ch website. Tickets already purchased and printed with the old date remain valid for the new game date. For fully paid and acquired single tickets directly through Hockey Club Lugano SA ticketing, there is the possibility, up to five working days after the postponement is published on the hclugano.ch website, but no later than three working days before the new game date, to return them for a refund of the purchase price (minus fees) or exchange them for another game if still available. For tickets purchased through Ticketcorner AG, the general terms and conditions of Ticketcorner AG (www.ticketcorner.ch) apply.

Lost Single Tickets/Season Tickets/Packages
Single tickets purchased directly through Hockey Club Lugano ticketing, lost season tickets, and packages, provided they are in the system, can be replaced with a duplicate. A fee of CHF 5.00 is charged for the duplicate of a single ticket, and CHF 20.00 for the duplicate of a season ticket or package.

Transferability and Resale of Tickets, Penalty

Transferability
Single tickets, season passes, and packages are generally transferable. The owner of the access title is responsible for any damage caused by the holder of the access title and may lose all rights associated with the access title. Individual tickets, season passes, or discounted packages can only be transferred to persons entitled to the same discount (for example, children's tickets can only be transferred to children).

Document Control
For single tickets and/or season passes and discounted packages, identity checks are carried out at the entrance to the rink. For single tickets, the match day is considered the determining day for any discount. For season passes, the day of purchase of the season pass is considered the determining day. Access to the rink is prohibited without a valid document.

Resale
For security reasons and to prevent black market and speculative activities, holders of an access title may acquire it solely for private use. Acquiring access titles for resale for commercial purposes (i.e., with a profit) without the prior consent of Hockey Club Lugano SA is prohibited. If Hockey Club Lugano SA finds that the holder of an access title has acquired it without the consent of the company for commercial purposes and/or resale and/or commercial transfer (e.g., through internet auctions), it is authorized to prohibit the holder of the title from accessing the rink and to issue a ban on rink access. Any violation of this contractual provision may also be sanctioned with a conventional penalty. The right to assert further claims for damages is expressly reserved.

Rink Access – Sound and Image Recordings

Presence in the rink is at one's own risk. Individuals or groups of individuals (e.g., all persons in a sector) who have been banned from rink access by the competent authorities (e.g., by the Swiss Ice Hockey Federation) or by Hockey Club Lugano SA or who are considered a security risk, cannot receive tickets and cannot access the rink. Tickets held by these individuals are canceled without any right to a refund of the ticket price.

The entry of banners is authorized exclusively with the consent of Hockey Club Lugano SA, which will ensure that their content is not racist, sexist, defamatory, or violent. The entry of devices for recording images and sounds for commercial use is prohibited. The entry of fireworks, umbrellas, bottles, cans, drugs, animals, and other dangerous objects is strictly prohibited. A detailed list of prohibited items is indicated in the Rink Regulations. By purchasing a single ticket and/or a season pass and/or a package, the buyer accepts the Rink Regulations and the General Terms of Purchase of Hockey Club Lugano SA.

Each holder of an access title is required to undergo a security check at the entrance by the security staff. They are required, upon request, to allow pat-downs and permit security staff to check their personal effects. They are required to show and hand over for verification to the security staff and/or the Police their access title. Access is only possible with a valid access title. Holders of single tickets and/or season passes with a discount (children, minors, AVS/AI beneficiaries, Family Corner, students, apprentices, etc.) are always required to show at the entrance the documents that justify the discount. Otherwise, access to the rink will be denied.

Security staff are authorized to search individuals – even using technical aids – to verify if they may pose a security risk due to the influence of alcohol and/or drugs or for the possession of weapons and/or dangerous objects. Security staff are authorized to search inside clothing and containers. In case of suspicion, security staff are also authorized to search individuals in intimate parts. In case of refusal by the holder of the access title, Hockey Club Lugano SA is authorized to prohibit access to the rink or to remove the person from the rink.

By accepting these General Conditions, each holder of an access title to the event irrevocably authorizes the use of their image and voice free of charge in all present and future media in the context of photographs, live broadcasts, and/or sound and image recordings made by Hockey Club Lugano SA or its agents in relation to the event.

Behavior at the Event Venue

In the interest of safety and orderly conduct of the event, the holder of the access title is required to follow the instructions of the Police, Hockey Club Lugano SA, and security staff. It is forbidden for the holder of the access title to bring any items to the event venue with the intention of offering them for sale or using them for commercial purposes. Items brought for this purpose or actually offered for sale may be seized by security staff or other authorized persons or kept until the end of the event. Any violation of this contractual provision may also be sanctioned with a conventional penalty. Hockey Club Lugano SA explicitly reserves the right to take further legal action.

Data Exchange for Security Reasons

In case of incidents and/or disturbances occurring before, during, and after a match that require the identification of the persons involved, the clubs and the National League reserve the right to exchange relevant personal data. The data exchange will be conducted in compliance with current data protection regulations and exclusively for the purpose of ensuring the safety and integrity of ice hockey matches. In this context, the holder of the access title consents to the exchange of relevant personal data if such exchange is aimed at identifying persons in case of incidents and/or disturbances before, during, and after a match.

Entry onto the Ice

Entry onto the ice surface, including the surrounding area behind the boards and technical rooms, is strictly prohibited. Violations of this prohibition will be punished with a financial penalty.

Abuse/Security

Violations of these General Conditions and/or the Rink Regulations will be punished with removal from the rink without a refund of the ticket price. Hockey Club Lugano SA also reserves the right to block the user's account, issue a rink access ban, and/or take other legal actions if necessary. In the event of a rink access ban being issued, the recipient will be charged a flat fee of CHF 500.00 for expenses related to the fact-finding and administrative costs. Further claims for damages are reserved.

Applicable Law

The invalidity of individual provisions of these General Conditions does not affect the validity of the other provisions. Invalid provisions are replaced by provisions that come closest to the purpose of the invalid provisions. Hockey Club Lugano reserves the right to change these General Conditions at any time without notice to the holder of the access title.
